1. Purpose
These Terms govern the contractual relationship between TaleWiz (Gabriel Perales, owner of www.talewiz.com) and the user who contracts the AI-generated personalized children's storybook service.
2. Service description
TaleWiz lets you create a personalized 7-page children's storybook with AI-generated illustrations, from the details and photo you provide. The price of the service is €2 per book (one-time payment, VAT included).
The storybook stays available in the user's library and can be downloaded as a PDF.
3. Purchase process
- The user completes the wizard (child's name, photo, theme).
- Pays €2 via Stripe.
- TaleWiz generates the story and illustrations using AI.
- The user can preview, edit illustrations, and download the PDF.
The contract is completed the moment payment is confirmed.
4. Price and payment
The price is €2 per book, VAT included. Payment is made by credit/debit card via Stripe (a PCI DSS platform). TaleWiz does not store card data.
5. Right of withdrawal and refunds
In accordance with article 103.a) of Spanish Royal Legislative Decree 1/2007 (TRLGDCU), the user expressly waives the right of withdrawal from the moment they request the story generation to begin, since this is personalized digital content whose execution begins with their prior consent.
However, if the service is not delivered correctly for reasons attributable to TaleWiz (a technical failure preventing story generation), the user may request a redo or full refund within 14 days by contacting hola@talewiz.com.
6. Use of generated content
Stories and illustrations are for personal, non-commercial use. Resale or commercial distribution without express authorization is prohibited.
TaleWiz may use anonymized examples of the service for promotional purposes, never including photos of minors without express consent.
7. Responsibility for AI-generated content
Stories and illustrations are generated by AI models. TaleWiz does not guarantee the content will be exactly as expected. The user can review and regenerate illustrations before downloading.
The user is responsible for ensuring that the photos and details provided correspond to people over whom they have parental authority or legal guardianship.
8. Data protection
The processing of personal data is governed by our Privacy Policy .
9. Changes
TaleWiz may modify these Terms with reasonable prior notice. Continued use of the service implies acceptance of the Terms in effect.
10. Applicable law and dispute resolution
These Terms are governed by Spanish law. For out-of-court resolution, you may use the European Commission's ODR Platform: ec.europa.eu/consumers/odr .
For judicial disputes, the parties submit to the Courts and Tribunals of the user's domicile in accordance with consumer protection regulations.
